01

Agreement

These Terms of Service are an agreement between WaveWage LLC, an Arizona limited liability company ("WaveWage"), and the business that opens an account (the "Customer"). By creating an account or using WaveWage, you accept these terms. If you are accepting on behalf of a business, you confirm you have authority to bind it.

02

The service

WaveWage lets restaurant operators define bonus rules, run live sales- and hours-aware bonus pools, and pay them out at the end of a shift. It reads scheduling, attendance, and point-of-sale data from the systems a location already uses and presents real-time views to operators and employees.

03

Eligibility and accounts

You must be at least 18 and able to form a binding contract to use WaveWage. You are responsible for the activity under your account and for keeping credentials secure. Notify us promptly if you suspect unauthorized access. You are responsible for the accuracy of the wage rates, rules, and configuration you enter.

04

Acceptable use

You agree not to:

  • Use WaveWage to violate any law, including wage-and-hour or employment law.
  • Access data for employees or locations you are not authorized to manage.
  • Probe, scrape, overload, or reverse-engineer the service, except as the law allows.
  • Misrepresent to employees how their pay is calculated.
05

Your data and your responsibilities

As between you and WaveWage, you own the data you put into the service and the payout records it produces. You grant us the rights needed to host and process that data to provide the service.

You remain responsible for your own payroll, tax, and employment-law compliance. WaveWage calculates and displays bonus amounts from the data and rules you provide; it does not file taxes, run payroll, or determine what you are legally obligated to pay. You are responsible for reviewing payouts before they are paid through your payroll process.

06

Third-party integrations

WaveWage connects to third-party systems, such as your scheduling/time provider and payment processor, at your direction. Your use of those systems is governed by their own terms, and we are not responsible for their availability or accuracy. You authorize WaveWage to access those systems on your behalf to provide the service.

07

Fees and billing

Paid plans are billed in advance through our payment processor on the cycle shown at sign-up. Fees are non-refundable except where required by law. We may change pricing with notice; changes take effect on your next billing cycle.

08

Early access

WaveWage is offered as an early-access product. Features may change, and the service is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We work hard to keep calculations correct, but you should verify payouts against your own records.

09

Intellectual property

WaveWage, its software, and its design are owned by us and protected by intellectual-property law; aspects of the product are patent pending. These terms grant you a limited, non-exclusive, non-transferable right to use the service. We welcome feedback and may use it without restriction or obligation.

10

Disclaimers

WaveWage is a tool for calculating and visualizing bonus pools. It is not payroll, accounting, tax, legal, or financial advice. Nothing in the product creates an obligation for you to pay any particular amount; your pay decisions and their legality remain yours.

11

Limitation of liability

To the fullest extent permitted by law, WaveWage will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not fully apply to you.

12

Termination

You may stop using WaveWage at any time. We may suspend or terminate access if you breach these terms or if needed to protect the service or other users. On termination, your right to use the service ends; you can request an export of your data within a reasonable window before deletion.

13

Changes and governing law

We may update these terms; material changes will be dated at the top of this page and, where significant, communicated to operators. These terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules.
